What is Indiana’s dog bite law?

Unlike some states, Indiana does not have a “one bite rule” when it comes to dog attacks. Instead, dog owners can be held legally responsible for an animal attack in many cases, even if the dog has never attacked anyone before.

In general, the dog owner has a responsibility to keep their dog under control at all times. As a result, if the dog owner behaves in a negligent or reckless manner, you may be able to take legal action against the dog owner.

Examples of negligent or reckless behavior on the part of a dog owner can include:

  • Not having the dog on leash in public
  • Not having the dog properly fenced in or contained on their property
  • Specifically instructing the dog to attack someone on command

These are just a few situations in which a dog’s owner can be held liable (legally responsible) for a dog attack. Many other situations often occur. That’s why it’s important to talk to a lawyer if a dog has attacked you or your child. You may be able to take legal action against the dog owner or another at-fault party in certain cases.

Can I sue for a dog bite?

In many circumstances, you can file a lawsuit or take other legal action against the dog’s owner after an animal attack. In addition, you can also sometimes file a lawsuit against a landlord if a tenant’s dog attacked you or another family member.

Such legal cases often involve premises liability law. This area of the law concerns the legal responsibilities of property owners. Indiana’s at-fault system also often comes into play in such legal cases. This simply means the at-fault party (often the dog owner or the dog owner’s insurance company) is responsible for financially compensating people injured in a dog attack.

It’s also important to understand that you only have a limited amount of time to take legal action in most cases. Under Indiana law, you only have two years from the date of your dog attack to file a lawsuit or take other legal action. If you miss this deadline, you could miss out on your only opportunity to get the money you deserve for all your injury-related expenses.

What can I be compensated for?

Victims of a vicious dog attack are often eligible to be financially compensated for all injury-related expenses. This includes short-term medical bills (often for emergency medical care) as well as any future medical expenses due to long-term health issues due to being bitten or attacked by a dog. Such expenses can include compensation for:

  • Surgical procedures, including reconstructive surgery or plastic surgery due to scars caused by a dog attack
  • Infections or other medical complications due to a dog bite
  • Prescription medications, often for infections or chronic pain
  • Follow-up doctor’s appointments
  • Replacement income during your recovery if cannot work
  • Lost future income if you cannot return to work due to your animal attack

The pain and suffering often associated with a serious animal attack is real. You shouldn’t have to pay for your medical bills or other expenses associated with your injury. Demand the compensation you deserve. Talk to a lawyer who can stand up for your rights and build a strong legal case in support of your claim.

Dog bite cases can often be very challenging. Often, the dog owner denies doing anything wrong. They might even try to claim you somehow provoked the dog and instigated the attack. Worst of all, the dog owner’s insurance company will often take their side. That’s because there’s often a lot of money at stake in legal cases involving serious animal attacks.

Insurance companies don’t intimidate us. We know the games they play and know how to take them on and win. In many cases, it often comes down to thoroughly investigating the attack and finding strong evidence in support of your claim. Many insurance companies and other at-fault parties agree to cooperate once they see we’re serious about your case. If not, we will not hesitate to file a lawsuit on your behalf in pursuit of the money you deserve.
